1. Scope
These Terms & Conditions apply to all contracts between ServiceFlow (hereinafter "Provider") and users of the platform (hereinafter "Customer") regarding the use of the ServiceFlow Software-as-a-Service platform.
By registering and using ServiceFlow, the Customer accepts these Terms in full. Deviating terms of the Customer only apply if the Provider has explicitly agreed to them in writing.
2. Service Description
ServiceFlow is a cloud-based management software for automotive workshops and similar businesses. The Provider gives the Customer internet access to the following features: customer management, appointment scheduling and calendar, invoice creation and management, operations dashboard, settings and user management.
The Provider is entitled to expand, adjust, or — with reasonable advance notice for significant changes — reduce the scope of features at any time.
3. Registration and User Account
Registration is required to use ServiceFlow. The Customer is obligated to provide truthful and complete information and keep it up to date.
The Customer is responsible for the security of their login credentials. They are liable for all actions taken under their account. The Provider must be notified immediately if misuse is suspected.
In principle, one account per company/workshop is intended. Sharing login credentials with third parties is prohibited.
4. Trial Period and Subscription
After registration, the Customer has access to a free trial period. The scope and duration of the trial period are indicated on the platform.
After the trial period ends, a paid subscription is required for continued use. Current prices are transparently displayed on the platform. The subscription automatically renews for the chosen term (monthly or annually) unless cancelled in time.
Billing is processed through Stripe. By completing a subscription, the Customer agrees to Stripe's payment terms.
5. Prices and Payment Terms
Current prices are viewable on the platform under "Subscription". All prices are in Swiss Francs (CHF) including applicable VAT.
Payments are due in advance. In the event of failed payments, the Provider reserves the right to suspend platform access until the outstanding payment is settled.
6. Cancellation
The Customer can cancel their subscription at any time through the platform ("Subscription" → "Manage subscription"). Cancellation takes effect at the end of the current billing period. No partial refunds of already paid amounts are made.
The Provider is entitled to terminate the contract extraordinarily if the Customer violates these Terms, particularly in cases of misuse or payment default.
7. Data Protection
Protecting Customer data is a central concern for the Provider. The processing of personal data is carried out in accordance with the Privacy Policy, available at /datenschutz, which forms part of these Terms.
The Provider commits to using Customer data exclusively for providing the agreed services and not to share it with unauthorized third parties.
8. Availability and Maintenance
The Provider strives to ensure high platform availability but does not guarantee uninterrupted availability. Planned maintenance work will be communicated in advance where possible.
The Provider accepts no liability for outages caused by force majeure, technical disruptions at third-party providers, or other causes outside the Provider's control.
9. Limitation of Liability
The Provider is only liable for damages caused by gross negligence or intent. Liability for slight negligence, indirect damages, lost profits, or data loss is excluded to the extent permitted by law.
The Customer is responsible for backing up their own data. The Provider recommends regular independent data backups.
10. Intellectual Property
All rights to the ServiceFlow platform, including software, design, trademarks, and content, remain with the Provider. The Customer is granted a non-exclusive, non-transferable right of use for the duration of the subscription.
The Customer may not decompile, reverse-engineer, or otherwise misuse the platform.
11. Changes to Terms
The Provider reserves the right to adjust these Terms at any time. Customers will be informed of significant changes by email or through the platform. If the Customer does not object to the amended Terms within 30 days of notification, the changes are deemed accepted. In the event of objection, the Customer has the right to extraordinary cancellation.
12. Applicable Law and Jurisdiction
These Terms are subject to Swiss law. The exclusive place of jurisdiction for all disputes arising from or in connection with this contract is Zurich, Switzerland, unless mandatory legal provisions dictate otherwise.
